New Standards for HIPAA and Hypnotherapy

IAIH 2019 Annual Conference

At the Institute of Interpersonal Hypnotherapy, we have always prided ourselves that we are “Raising the Standards of Hypnotherapy Training.” Through our Association, the International Association of Interpersonal Hypnotherapists, we continually work to protect the free and open practice of Hypnotherapy by ensuring that our students, graduates, members, and staff are operating at the highest levels of professionalism, with high ethical standards, proper semantics in advertising, solid scope of practice assessment protocols, and a clear understanding of Hypnosis Law.

With this in mind, we discussed HIPAA and Hypnotherapy at our recent Hypnotherapy Conference, and also in a very recent online discussion forum. Recent News

IAIH worked with the City of Lighthouse Point in Broward County, Florida to change their understanding of Florida Hypnosis Law.  Broward County now considers the practice of Hypnotherapy to be within the realms of “alternative/holistic medicine” when granting Business Tax Receipts and the City of Lighthouse Point has placed our occupation under the category of “mental health counseling.”

This movement towards being more and more respected as a legitimate profession requires that we “walk the talk,” and abide by the highest standards of professionalism, as we make significant progress in how we are viewed as Hypnotherapists.

HIPAA Compliance

HIPAA laws require that when a medical professional makes a referral to another professional that the person who receives that referral is considered a ‘Business Associate.’  A Business Associate is also bound by HIPAA, and must maintain the same standards as the referring practitioner.  At a recent IAIH online meeting, our member-driven association concluded the following about Hypnotherapists who receive medical referrals, in that they should:

  • take an online HIPAA Compliance Training course
  • consider using a HIPAA Compliant Practice Management System
  • have clients fill out HIPAA Client Rights and Therapist Duties Forms.
